Important Update: Introduction of the New eVisa System for Right to Work Checks

As part of ongoing changes to the UK’s immigration system, a new eVisa system will soon replace physical documents such as Biometric Residence Permits (BRPs) and Biometric Residence Cards (BRCs) for confirming a worker’s immigration status.

What Does This Mean for Workers?

Any worker currently holding a BRP or BRC will be required to create a UK Visas and Immigration (UKVI) account to access their eVisa. This must be done before 1st January 2025. Once registered, workers can generate a share code to allow you to confirm their immigration status online.

Key Dates to Remember:

  • By 31st December 2024: All BRPs and BRCs will expire. Workers need to register for a UKVI account and secure their eVisa before this date.
  • From 1st January 2025: Employers must verify a worker’s immigration status via their eVisa, unless the worker holds a UK or Irish passport.

What Employers Need to Know:

It’s critical to ensure that workers are aware of this change and have taken the necessary steps to secure their eVisa before the expiration of their BRP or BRC. Delays or failure to obtain an eVisa could lead to disruptions for both the employer and the worker.

Additionally, you should check any contracts of employment to ensure they reflect the updated right to work requirements and that workers are aware of the new process.
